Step 3: API Professional Review Handling process

Post Lodgement

Once a professional review has been lodged the Professional Conduct Officer will:

  1. acknowledge receipt of the professional review
  2. assign a professional review matter number and name
  3. request clarification where required
  4. complete a preliminary assessment of the matter in accordance with section 8 of the Professional Conduct Policy
  5. provide the Member an opportunity to respond to the professional review
  6. complete a substantive investigation into the matter and prepare a report for consideration of the Professional Conduct Panel

 

Professional Conduct Panel Consideration

Once a substantive investigation has been completed:

  1. a Panel will be formed to consider the matter who have confirmed no conflicts of interest
  2. the Panel will meet and deliberate on their decision for the matter
  3. the Panel may seek clarification and/or advice before preparing any documentation.

No Finding of Professional Misconduct

The Panel will prepare a Determination Report detailing the dismissal of the matter and their reasons.

Interim Finding of Professional Misconduct

The Panel will prepare a Determination Report detailing an interim finding of professional misconduct and their reasons and a charge letter detailing the Members rights and next steps.

Hearing

A Hearing is scheduled if an interim finding of professional misconduct is made against the Member.

No Finding of Professional Misconduct

The Committee will prepare a Findings Report detailing the dismissal of the matter and their reasons.

Finding of Professional Misconduct

The Committee will prepare a Findings Report detailing a finding of professional misconduct and their reasons.

Appeal

A Member with an adverse finding of professional misconduct may appeal in accordance with section 16 of the Professional Conduct Policy.
