Guidance Paper released – APGP 402 Native Title Matters

The API is systematically reviewing its standards to meet the changing and future needs of Members.
The API reviewed the paper Native Title Issues guidance paper and released an exposure draft for consultation between 30 November and 16 December 2022.
Based on the feedback and comments received during this consultation period, the API has finalised and published the updated guidance paper which had an effective date of 1 July 2023, with earlier adoption permitted and encouraged.
The purpose of this guidance paper is to provide guidance to Members in relation to the concept of “native title” and is designed to be used by API Members as well as other property professionals who may have limited experience with respect to native title matters. It focuses on native title from the important perspective of native title as a form of property rights protected by the law, which are meaningful and need to be respected.
