This webinar will identify the processes and practices involved for an expert witness in the family law valuation field, focusing on the more unique aspects of this specialized niche within the industry. Attendees will explore the valuation practices generally in play from pre-engagement liaison through a letter of instruction, preparation for and completion of the valuation report, subsequent queries and clarifications, and court appearances. Members will have an opportunity to evaluate best practices for the valuer as an expert witness in family law, including how valuers can assist in the process, the challenges and pitfalls faced, and the changing landscape into the near future.

Upon completion of this webinar, Members will be able to develop a further understanding of the following areas:

  • The single expert appointment and the associated Family Law rules and protocols and the difference between a single expert and adversarial expert and the conference of experts.
  • How to communicate with the parties and their lawyers.
  • Knowing your role; not being drawn into the dispute by parties or their lawyers.
  • The valuer’s report.
  • The Court process, cross-examination and duty to the Court.

David Bird, Director, Kohler Bird Valuers
David Bird is the  Director and Valuer Principal of Kohler Bird Valuers, founded in 1990. For more than 20 years Kohler Bird was a broad-based valuation practice of up to 12 valuers, with an affiliated office in South East Queensland. The firm’s main area of work for this time centred on mortgage valuation, though  throughout the years there had been an increasing specialisation in valuations for litigation, family law and expert witness appointment, along with prestige residential property. In 2010 the mortgage valuation practice of Kohler Bird in both NSW and Queensland was merged with a national based valuation company, and Kohler Bird Valuers became a specialised boutique valuation practice focused on family law and litigation valuations and consultancy. David has worked solely and constantly as a property valuer since 1983, covering Sydney and its environs, as well as coastal and country NSW, and over this period have gained extensive experience in all areas of real estate valuation, ranging from residential through commercial, industrial, investment and tourist/entertainment properties. He continues to hold registration as a valuer in Queensland, where his expertise lies in coastal and prestigious residential property. David is an Associate of the Australian Property Institute and has been a Member of this professional body since 1983. He is also designated a Specialist Retail Valuer under the API Listing. David has carried out valuations for litigation purposes throughout his 38 year career and appeared as an expert witness in numerous matters in the Family Court of Australia, Federal Circuit Court, NSW District Court, Supreme Court, Land and Environment Court, and the Consumer, Trader & Tenancy Tribunal and NSW Civil & Administrative Tribunal. David conducts the majority of litigation matters for the practice and has specialised in Sydney residential, commercial and industrial valuations and is recognised by all of the major family law firms as an expert in the valuation field. He has extensive experience as both a Joint Appointed Expert Witness and Adversarial Expert in Family Law, which has formed the majority of his workload over the past decade. David also has extensive valuation experience throughout the coastal, tourist resort and rural areas of NSW & QLD, as well as having conducted numerous valuations in the ACT and specialized matters within other states of Australia.
Kimberly Hunter, Director, Clancy & Triado
Kimberly started her legal career in New Zealand where she was admitted. She worked in London for several years and came to Australia in 1996 when she joined Clancy & Triado. She became a partner in 2000 and has since developed into one of the most highly regarded and professional family lawyers. Kimberly obtained her specialist accreditation in 1999 and has carved out a niche in complex parenting cases and international disputes. She also deals with complex property and commercial disputes. Kimberly takes great pride in providing clients with advice that may help and guide them. Family law is not always about litigation and does not necessarily come at a great cost. Informing clients and working with them and other practitioners through mediation, productively and respectfully, can resolve matters and minimise conflict. Kimberly also gives back to the community and has been a board member of Relationships Australia (Vic) for the last eight years. Kimberly is consistently regarded as a leading family law and divorce lawyer and parenting and children’s matter lawyer in the Doyles Guide.
