Overview and Changes to the Retail Leases Act (N171010)

Following a major review by the NSW Office of Small Business Commissioner (OSBC), the NSW Parliament has passed the Retail Leases Amendment (Review) Bill 2016 which amends the Retail Leases Act 1994.
The amendments primarily relate to the obligations of both landlords and tenants and any API member who is involved with managing, leasing or valuing retail property should familiarise themselves with the new Act and amendments.

Russell Briggs, Director, Legal & Rental, Valuation & Advisory Services, Colliers International
Russell is currently a Director with Colliers International Valuation and Advisory Services and heads up their Legal and Rental team. He has been a registered valuer for over 25 years and is a Fellow of the API and former Councilor and Senior Vice President of the NSW Division of the Australian Property Institute.
Russell specialises in rental valuations and determinations, lease disputes, Land and Environment and Family Court work and in recent years has been exposed to land fill and quarry valuations. Russell has been actively involved in retail lease dispute matters since the mid 1980’s during his time at Woolworths as the NSW Real Estate Manager where he oversaw numerous rental and lease disputes of both larger and smaller retail premises which Woolworths in the main were the Lessee.
Over the last 20 years this has broadened to acting for a range of Lessor and Lessee clients for retail property and on many occasions as a determining valuer in these disputes.
In 2002 Russell became the API’s representative on the Ministerial Advisory Committee for Retail Leases which canvassed numerous issues concerning the Retail Leases Act particularly around the determination of market rentals for premises covered under the Act. He remains on the API Retail Advisory Sub-Committee and remains passionate about process and valuers understanding of this Act.
