The Land Acquisition (Just Terms Compensation) Amendment Act 2016 expanded the notion of solatium significantly in both quantum of compensation and applicability. In 1993 in the Carson case solatium was described as compensation for injured or hurt feelings, however increasingly solatium is being awarded on the basis of a broader understanding of losses or inconvenience arising from compulsory acquisition by reason of the forced nature of the acquisition. It is also being increasingly argued that solatium ought to apply to specific commercial premises in certain circumstances.

Patricia Lane is a barrister and senior lecturer in law at Sydney University. She teaches property, equity, contracts, conveyancing and legal interpretation. Patricia practises in the areas of property, environmental and commercial law, including in native title matters and in compensation for compulsory acquisition. She has represented both individuals and authorities in her practice, and has presented seminars on topics including expert evidence, compulsory acquisition, evidence, and land law for both experts and lawyers, particularly in respect of the practice areas of valuation and native title. Patricia was formerly a member of the National Native Title Tribunal, and has consulted internationally in relation to land and natural resource issues.
