Executive Forum: Just Terms - s. 56(3) - A Legal Perspective and Recent Cases (N180529)
The Land Acquisition (Just Terms Compensation) Amendment Act 2016 introduced for the first time the notion of replacement value for special lands which essentially cannot be replaced at their existing value. s. 56(3) requires that land used for a specific purpose such as a park or church (but not limited to such uses) is to be valued on the basis of replacing that land in the vicinity of its location (or nearby) at a value which is unrelated to the specific use purpose. This approach in the 2016 legislation introduces a change in the way in which compensable worth is assessed, away from the venerable Spencer case which has been the basis of valuation and compensation since the early part of last century.

Nicola is an environmental and planning lawyer based in Sydney.
Nicola's practice covers all areas of environmental law, including waste, pollution, contaminated land, planning law and compulsory acquisition. Nicola's extensive experience includes environment and planning advisory work, litigation, transactional matters and regulatory/compliance work.
In addition, Nicola has extensive experience acting for government agencies and private clients in litigation in the Land and Environment Court of NSW, Supreme Court of NSW, NSW Court of Appeal, and special leave applications to the High Court of Australia. In particular, Nicola is currently acting for RMS in the largest compulsory acquisition matter in NSW's history, relating to the acquisition of the Alexandria Landfill and claims in excess of A$400m.

He is regularly appointed as an expert determining valuer in rental disputes, and acts as an expert witness in resumption matters and other litigation involving valuation principles and assessments.
